The firm has six main areas of practice: local government law, zoning and land use, condemnation/eminent domain, insurance defense litigation, business litigation, and serious personal injury/wrongful death/civil rights.
A. Local Government Law
Through the expertise of partners Frank E. Jenkins, III and Peter R. Olson the firm specializes in litigation and consulting services for counties, cities, and public authorities throughout the State of Georgia. The particular areas of specialization include zoning and land use, jails and law enforcement, defense of civil rights and §1983 cases, and ordinance and procedures drafting. The firm represents Bartow County in numerous matters and has advised and represented many of the counties and cities in this state.
B. Zoning and Land Use Law
The firm is well-known in Georgia for its expertise in handling zoning and land use litigation. Jenkins & Olson generally represents local governments, but also takes cases on behalf of property owners and neighbors in certain jurisdictions. The firm has been involved in many of the key Supreme Court decisions that have shaped zoning law in this state over the past twenty years. The attorneys practice in this area statewide, as the firm has represented clients from North Georgia, the Atlanta region, South Georgia and the coastal plain area. The firm also reviews zoning ordinances to advise local governments how to avoid potential legal problems.
C. Condemnation/Eminent Domain
Jenkins & Olson’s attorneys have established themselves as experienced litigators in matters involving condemnation and eminent domain. The firm’s primary goal is to protect the property rights of landowners whose property has been taken by government agencies, such as in the case of road projects and power line implementation. When approached by the Department of Transportation or Georgia Power Company, many individuals are not aware of their rights, nor are they familiar with the appeal options available to them. The attorneys at Jenkins & Olson offer free consultations to property owners in these situations and, if retained, set out to help their clients achieve the most satisfactory settlement or jury verdict, should the case go to trial.
D. Insurance Defense Litigation
The firm's trial attorneys have developed a much respected reputation in insurance defense litigation. Frank Jenkins is the co-author of Georgia Automobile Insurance Law, Including Tort Law, which is the authoritative auto insurance book in Georgia, used by most attorneys and insurance companies in this area of practice. The firm defends first- and third-party claims arising from automobile collisions, slip and fall, and premise liability and pursues insurance coverage disputes through declaratory judgment actions. The firm achieves excellent results while controlling costs. Insurance defense matters take the firm's attorneys from the metro-Atlanta area to as far south as Savannah, and even as far north as the Tennessee border. The insurance defense team also defends cases on appeals to the Court of Appeals and the Supreme Court of Georgia.
E. Business Litigation
The firm has represented many corporations and individuals in business disputes. It has handled multi-million dollar contract cases, complex products liability cases, and insurance coverage disputes, as well as smaller matters. The firm has sufficient staff, resources and expertise to try large and complex cases, and the client receives the benefit of personal attention from the partners.
F. Serious Personal Injury/Wrongful Death/Civil Rights
The firm represents plaintiffs in serious personal injury or wrongful death cases. The extensive trial experience of the firm's attorneys makes this firm well suited to evaluating and trying personal injury cases. The experience gained in defending §1983 civil rights actions translates into successful prosecution of civil rights claims. The firm has had considerable success in this area and its expertise and familiarity with the juries of North Georgia contribute to that success.
